Rental Agreement — Cottage Creators

I, the guest ("The Guest"), understand and agree to the following terms and conditions

1. Fees
Payment of fees for the stay are due at the time of booking unless previously

arranged.

2. Pets

We love animals and we allow pets. Any pets that will be on the property must be mentioned and approved by the host. All animals need to be cleaned up after and dog waste should be disposed in the garbage.

3. Cancellation Policy

We have a strict cancellation policy: Full refund for cancellations made within 48 hours of booking, if the check-in date is at least 14 days away. 50% refund for cancellations made at least 7 days before check-in. No refunds for cancellations made within 7 days of check-in.

4. Additional Guests

The total number of guests in the booking should be the total number of unique individuals that will be at the place. For example, if you have 4 guests,

and two of them stay one night and leave, and two others come - that is 6 people entering the property. If this number might exceed the number of people the booking is for, this needs to be communicated to the host and agreed to in advance by the host.

5. Number of Guests

The number of overnight guests at the Property on any night during the Rental Period shall not exceed 8 at any time at The Water's Edge Cottage or 6 at the Muskoka Nest or Muskoka Cabana cottages. In the event the number of overnight guests at the Property exceeds the said maximum number, the Guest shall pay to the Host $200.00 per night per overnight guest over the maximum number and may result in immediate termination of the stay without refund.

6. Security Deposit

The Security Deposit of $500 will be held for the observance and due performance of the terms and conditions of this Agreement. Damage or extraordinary cleaning issues with the cottage, if applicable will be discussed with the Guest within 14 days following departure. An invoice totalling damages / cleaning will be sent to the Guest and will be paid by the Guest from the security deposit.

(The cleaning fee already paid by the Guest covers reasonable cleaning of the property and laundering of all linens and towels. Extraordinary cleaning fees relate to excessive waste left on the Property, bags of garbage not properly disposed of in the garbage bin, significant stains to linens/towels/throw blankets or other décor items, and similar related issues.)

7. Rental Period

The rental period (the “Rental Period”) shall be the period commencing on the Arrival Date and ending on the Departure Date, unless terminated in accordance with the provisions of this Agreement. These dates are either set up via our online booking tooling or another direct communication with the guest.

8. Check in and Check out

The Guest shall check in no earlier than 4 pm on the Arrival Date and check out no later than 10 am. on the Departure Date unless previously arranged in writing with the host. Neither the Guest nor any of the Guest’s guests shall be entitled to access the property at any time outside of these times.

9. Telephone/Internet
You will be expected to use your own cellular phone while at the Property. There is no landline phone.

Unlimited internet is provided. The Wi-Fi password will be provided to you on the day that you check into the Property. The internet is not to be used for any illegal activities. Use of the internet for any illegal activities will result in immediate termination of the Guest and guests’ stay at the Property without refund. Internet is provided on a best-effort basis and is subject to any weather or provider issues that may arise. If there are issues during the guest's stay, the host will work with the internet provider and the guest to attempt to fix them, but internet is not guaranteed during the stay.

10. Use of Property by Guest
During the Rental Period, the Guest and the Guest’s guests shall:

Maintain the Property at all times in a good and tidy condition;
Not smoke cigarettes, cigars or any substance or vape inside the Property at any time. Smoking is permitted outside the residence. All cigarette butts must be disposed of outside the Property in a safe manner;
Not cause or create a nuisance in any way, including, but not limited to, refraining from playing loud music inside or outside the property at any time to cause excessive noise that would disturb the neighbours. Reasonable noise levels are acceptable during the day and early evening. Noise should be kept to an absolute minimum after 11 p.m. in accordance with the local by-laws.
Properly use and operate all equipment, machinery and appliances at the Property;
Not move or rearrange any furniture inside the Property;
Not flush sanitary items or anything other than toilet paper down the toilet;
Not sit on furniture in wet bathing suits;
Comply with all applicable laws and by-laws in connection with their use of the Property; and
Leave the property in the same condition of cleanliness in which they find the Property.

11. Maintenance by Host

In the event of failure of any piece of equipment, machinery or appliance at the Property during the Rental Period, the Host, may be contacted at info@cottagecreators.ca or at 647-989-4717.
Notwithstanding the foregoing the Host does not guarantee the operation of any piece of equipment, machinery, or appliance serving the Property, and there shall be no discount to or refund of any portion of the Rental Rate for failure, during the Rental Period, of any piece of equipment, machinery or appliance serving the Property.

12. Access by Host or Agent

The Host or an Agent for the Host shall be entitled to access the Property upon reasonable notice during the Rental Period for the purposes of supplying services effecting maintenance or repairs and performing inspections.

13. Damage and Replacements

The Guest shall report any damage to the Property upon arrival or occurrence.
The Guest shall be responsible for any damage to or loss from the Property which occurs during the Rental Period.

The Host or the Host’s Agent shall inspect the Property within 14 days of the the Guest’s departure and shall advise the Guest of any damage or replacements in respect of which the Guest is required to reimburse the Host. Such items will be charged according to repair or replacement value at the time of such repair or replacement, as determined by the Host or the Host’s Agent.

14. Waste

The Guest and the Guest’s guests shall temporarily place all garbage and recycling in the garbage bin next to the 1093 sign on the road leading in to the cottage in order to keep it away from wildlife during the stay. If the garbage is placed in a neighbour's bin, a $100 fee will be charged. Guests need to take all garbage and recycling with them after a stay and ensure that no garbage or recycling is left in the Cottage on the Departure Date.

15. Waterfront Activities

No children under 18 are to operate watercraft without adult supervision. The Guest is liable for all waterfront activities and shall be engaged in by the Guest and all Guests at own risk. During winter months should the Guest or Guests go ice fishing, skating, or other similar activities on the frozen lake these activities are engaged in at the Guest or Guests own risk.

16. Indemnity

The Guest shall indemnify and save the Host and the Host’s Agent, harmless from and against any liabilities or any loss or damage whatsoever arising from, related to or in connection with the Guest’s rental of the Property including, but not limited to, any claim for liability for personal injury or damage or loss of property which is made, incurred or sustained by the Guest or any of the Guest’s guests at the Property during the Rental Period.

17. Termination by Owner

The Host or the Host's Agent, shall be entitled to terminate this Agreement if the Guest, or any of the Guest's guests, are in violation of any of the terms of this Agreement or, in the sole opinion of the Host or the Host's Agent, if the Guest or any of the Guest's guests’ use of the property is detrimental to the Property or creates a nuisance in any way.

18. Personal Information

18.1.The Renter Consents to the Owner or the Owner’s Agent obtaining any information about the Renter as the Owner or Agent may deem necessary at any time in connection with this Application, or matters arising therefrom or for the purpose of determining the Renter’s whereabouts if, at any time during or after the expiration of the Rental Period, the Renter is or becomes indebted to the Owner or the Owner’s Agent for any amount owing pursuant to its obligations under this Application.

18.2.The Renter further consents to the Owner or the Owner’s Agent taking any reasonable steps necessary to assess this Application. Such consent extends to (but not limited to) the obtaining of a consumer/credit report about the Renter.

18.3.The Renter further consents to the disclosure by the Owner or the Owner’s Agent of any information concerning the Renter to any credit reporting agency.

18.4.The Renter acknowledges that personal information provided by the Renter to the Owner or the Owner’s Agent will be used only for the purpose of this rental application.


The acknowledgements and consents contained herein are made by each party named as Renter herein.

19. Agreement

By agreeing to this in the booking application, I have read, understand and agree to abide by the Terms and Conditions as set out above. I understand that the cottage Host of 1093 Sutton Rd., Utterson, ON or the Host's Agents will not be liable whatsoever for any loss or any injury to myself or anyone on or using the cottage or its’ property during my rental term, however caused.
